What Is a Product Liability Action in San Antonio?

Chapter 82 of the Texas Civil Practices and Remedies Code defines product liability cases in Texas. It states that a product liability action is “Any action against a manufacturer or seller for recovery of damages arising out of personal injury, death, or property damage that was allegedly caused by a defective product – whether the action is based in strict tort liability, strict products liability, negligence, misrepresentation, breach of express or implied warranty, or any other theory or combination of theories.”

When Is a Product Considered Defective?

A product is considered defective when it is inherently or unreasonably unsafe for normal use. The defect generally falls into one of the following categories:

How Is a Product Liability Claim Proven?
